
All works carried out by AP Plumbing Services Pty Ltd either quoted or otherwise shall be subject to these Terms and Conditions. It is the sole responsibility of the client / Client to read the Terms and Conditions carefully and make their own enquiries and seek independent advice before engaging AP Plumbing Services Pty Ltd
By paying a deposit, signing (electronically or otherwise), and/or accepting this quotation, the client acknowledges acceptance and agrees to adhere to these terms and conditions.
1.0 DEFINITIONS
1.1 “AP Plumbing Services Pty Ltd ” shall mean AP Plumbing Services Pty Ltd Pty, its successors and assigns or any person or entity acting on behalf of and with the authority of AP Plumbing Services Pty Ltd.
1.2 “Client” means any persons, partnerships, trusts or corporate entities purchasing the Goods as specified in any AP Plumbing Services Pty Ltd invoice, document or order, or any person acting on behalf of and with the authority of the Client. If there is more than one, “Client” is a reference to each Client jointly and severally.
1.3 “Works” means all Goods or Services supplied by AP Plumbing Services Pty Ltd to the Client at the Client’s request from time to time (where the context so permits the terms “Goods‟ or “Services” shall be interchangeable for the other.
1.4 “Price” means the Price payable for the Services as invoiced by AP Plumbing Services Pty Ltd to the client.
2.0 PAYMENTS
2.1 The Client agrees to make progress payments as requested. If the client fails to make a progress payment when due, AP Plumbing Services Pty Ltd reserves the right to suspend all work until such time, progress payments are paid.
2.2The client agrees to pay the Price on the completion of Works.
2.3 Unless otherwise stated the Price does not include GST. In addition to the Price the Client must pay to AP Plumbing Services Pty Ltd an amount equal to any GST AP Plumbing Services Pty Ltd must pay for any supply by AP Plumbing Services Pty Ltd under this or any other agreement .The Client must pay GST, without deduction or set off of any other amounts, at the same time and on the same basis as the Client pays the Price. In addition the Client must pay any other taxes and duties that may be applicable in addition to the Price except where they are expressly included in the Price.
2.4 The Client grants AP Plumbing Services Pty Ltd permission to carry out transactions over the phone using their credit card details for the value of the invoice amount, or in accordance with any payment arrangement, deposit or progress payment.
2.5 A credit card transaction fee of 1% applies to all credit card payments.
2.6 Any payments which fall overdue shall incur a late fee of 10% per annum, accrued daily; until paid in full.
2.6 All quoted works are subject to any necessary variations and deemed to be required at the discretion of AP Plumbing Services Pty Ltd in order to carry out and complete works to Australian and Safety Standards. All variations will incur further fees and charges in addition to the original quoted amount.
2.7 Additional fees and charges shall apply for work required to be completed by AP Plumbing Services Pty Ltd outside of normal business hours 0600 to 1700 Monday to Friday; and the Client agrees to pay these additional fees and charges.
2.8 the Client acknowledges that all invoices provided by AP Plumbing Services Pty Ltd shall be provided in categories of labor, materials and GST only. Itemized accounts will not be issued.
2.9 Where the client requests a variation to works and AP Plumbing Services Pty Ltd agrees to supply variation to works, AP Plumbing Services Pty Ltd will provide the client with a Varied Work Order.
2.10 AP Plumbing Services Pty Ltd is not bound by the Varied Work Order supplied in accordance with above until such time that the client has signed the Varied Work Order and paid the deposit as set out in the Varied Work Order.
2.11 where the client has signed the Varied Work Order and paid the deposit the Varied Work Order forms part of the binding agreement between the Client and AP Plumbing Services Pty Ltd and the Client must do all things and pay AP Plumbing Services Pty Ltd the amounts set out in the Varied Work Order on the same terms as set out in these terms and conditions.
2.12 Where the Client either fails, refuses or neglects to pay AP Plumbing Services Pty Ltd for any amounts due and payable pursuant to these terms and conditions and as a result AP Plumbing Services Pty Ltd incurs costs to enforce these terms and conditions to recover amounts the client owes to AP Plumbing Services Pty Ltd; then those costs incurred (including legal costs) will also payable by the client to AP Plumbing Services Pty Ltd.
3.0 OWNERSHIP OF GOODS
3.1 The Client agrees that title and the proprietary rights associated with the works and the goods provided, including material and equipment shall remain and be vested in AP Plumbing Services Pty Ltd until such time as the Client signs all relevant documentation required and all monies due and to be paid shall be paid in full by the Client to AP Plumbing Services Pty Ltd, which is specifically licensed and authorised by the client to attend any premises where the goods or the equipment may be located and to remove such goods or equipment at the cost and expense of the client until payment in full is made.
3.2 The Client agrees that title and the proprietary rights associated with the works and the goods hereby sold, including material, equipment (“goods or equipment”), shall remain and be vested in AP Plumbing Services Pty Ltd until such time as the Client signs all relevant documentation required under this agreement and all monies due and to be paid under this Agreement shall be paid in full by the Client to AP Plumbing Services Pty Ltd which is specifically licensed and authorised by the Client to attend any premises where the goods or the equipment may be located and to remove such goods or equipment at the cost and expense of the client until payment in full is made or until the quotation expires or is cancelled.
- The Client consents to AP Plumbing Services Pty Ltd affecting and maintaining a registration on the Personal Properties Security Register in relation to any security interest contemplated or constituted by the Agreement.
- The Client undertakes to:
- do anything (in each case, including executing any new document or providing any information that is required by AP Plumbing Services Pty Ltd), so that AP Plumbing Services Pty Ltd may acquire and maintain one or more perfected security interests under the PPSA in respect of the Equipment and its proceeds and to register a financing statement or financing change statement and to ensure that AP Plumbing Services Pty Ltd’s security position, and rights and obligations, are not adversely affected by the PPSA.
- not register a financing change statement in respect of a security interest contemplated or constituted by the Agreement without AP Plumbing Services Pty Ltd’s prior written consent; and
- Not register or permit to be registered, a financing statement or a financing change statement in relation to the Equipment in favour of a third party without AP Plumbing Services Pty Ltd’s prior written consent.
4.0 CANCELLATION
4.1 AP Plumbing Services Pty Ltd may at its discretion terminate any agreement under these terms and conditions at any time giving at least 24 hours written notice. AP Plumbing Services Pty Ltd shall not be liable for any loss or damage what-so-ever arising from such termination.
4.2 The client must provide AP Plumbing Services Pty Ltd with at least 3 working days’ notice in writing of any cancellation of works.
4.3 Placing a deposit with AP Plumbing Services Pty Ltd secures and confirms the works to be performed by the Client. Where a deposit has been paid to AP Plumbing Services Pty Ltd deposits are non-refundable.
4.4 Where a client cancels any agreement, any Varied Work Order or order for goods and services to be provided by AP Plumbing Services Pty Ltd, whether or not, 3 working days notice in writing has been given, AP Plumbing Services Pty Ltd is entitled to retain from the deposit, amounts for any loss or damage suffered by AP Plumbing Services Pty Ltd by reason of the cancellation, including but not limited to, costs incurred in goods and materials ordered and workmen booked
5.0 WARRANTY
5.1 Except as otherwise provided in these terms, AP Plumbing Services Pty Ltd will provide a warranty for works completed under these terms and the Warranty shall be valid for 12 months (unless otherwise stated) from invoice date. Warranty shall only be valid on exact location and works as carried out by AP Plumbing Services Pty Ltd . Client must provide original invoice for proof of works.
5.2 for the duration of the warranty period, all valve and valve type parts, as well as, any specified items installed by AP Plumbing Services Pty Ltd must be serviced annually by AP Plumbing Services Pty Ltd. Failure to do so shall void all warranty. It is the sole responsibility of the client to arrange an appointment.
5.3 The Client shall inspect the goods and works on completion and must report any defects to parts or installation works within 48 hours in writing to AP Plumbing Services Pty Ltd of any alleged defects, shortage in quantity or damage. The client shall afford AP Plumbing Services Pty Ltd an opportunity to inspect the alleged damage / defect within 7 working days from date of written notice and give AP Plumbing Services Pty Ltd the opportunity to make good to Australian standards within 14 working days.
5.4 No warranty shall be provided on blocked sewer, drainage or storm water as set out at clause 10.1
6.0 INTELLECTUAL PROPERTY
6.1 any drawings or designs created by AP Plumbing Services Pty Ltd for the Client, remain the property of AP Plumbing Services Pty Ltd and shall only be used by the Client at AP Plumbing Services Pty Ltd discretion and with written consent to do so.
7.0 CLIENTS DISCLAIMER
7.1 The client acknowledges that they have made their own independent enquiries hereby disclaims any right to rescind, or cancel the contract or to sue for damages or to claim restitution arising out of any misrepresentation made to him/her by any servant or agent of AP Plumbing Services Pty Ltd and the Client acknowledges that he/she buys the services of AP Plumbing Services Pty Ltd Plumbing relying solely upon his/her own skill and judgment and that AP Plumbing Services Pty Ltd shall not be bound by nor responsible for any term, condition, representation or warranty other than the warranty given by the Manufacturer which warranty shall be personal to the Client and shall not be transferable to any subsequent Client.
8.0 UNDERGROUND SERVICES
8.1 The Client will indemnify AP Plumbing Services Pty Ltd and keep AP Plumbing Services Pty Ltd indemnified against any liability, loss, claim or proceedings of any kind (whether arising under statute or common law) arising from services provided by AP Plumbing Services Pty Ltd which require excavation, underground work and/or removal of landscaping. AP Plumbing Services Pty Ltd will not be liable for any repair work and any repair work required will be paid at the Clients expense. Such liability, loss, claims or proceedings includes but is not limited to a) Damage to the property, real or personal; b) Death or personal injury; and c) Consequential or economic loss of any kind.
9.0 ROCK and FILLED GROUND
9.1 Unless specifically included in written quotation and/or estimates, rock excavation, dewatering or supportive work such as pier and beams for filled or made up ground will be charged out as a variation to the original price. Quotation is based on excavation of clean soils only, unless otherwise specifically stated in writing.
9.2 Existing soils shall be returned to excavated areas where possible and ground shall left filled. Landscaping and concrete works are not included in quotation unless specified be in writing. All concrete, paving and landscape works including shrub / plant and lawn replacement will be treated as a variation as set out in 2.5 of this document.
10.0 DRAINS and SEWER
10.1 The Client understands that the presence of plant/tree root growth and/or blockages generally indicates damaged pipes. Additionally the Client agrees that blocked drains, sewer pipes and storm water lines cannot be permanently fixed by simply removing “plant/tree root growth” or cleaning the drain. Therefore, no warranty is provided in relation to future blockages regardless of timeframe reoccurring whether in the same location or other drainage / sewer lines within the same property.
10.2 The Client acknowledges that Close Circuit Television (CCTV) is a specialist piece of equipment which may or may not be used at AP Plumbing Services Pty Ltd’s sole discretion in an attempt to identify the source of the blocked drain. Should CCTV equipment be used the Client acknowledges that additional charges will imposed. The Client will be informed of cost prior to use and consent obtained.
11.0 DISPUTE RESOLUTION
11.1 If a dispute arises between the parties to this contract, then either party shall send to the other party a notice of dispute in writing adequately identifying and providing details of the dispute. Within seven (7) days after service of a notice of dispute, the parties shall confer at least once, to attempt to resolve the dispute.
12.0 COMPLIANCE WITH LAWS
12.1 The Client and AP Plumbing Services Pty Ltd shall comply with the provisions of any applicable Legislation and/or regulations that may be applicable to the works.
12.2 The Client shall obtain (at the expense of the Client) all licenses and approvals that may be required for the works (councils or other governing agents).
12.3 The Client agrees that the site will comply with any occupational health and safety laws relating to building/construction sites and any other relevant safety standards or legislation for the State of Victoria.
13.0 GENERAL
13.1 The client agrees to AP Plumbing Services Pty Ltd using their personal information for marketing purposes and gives AP Plumbing Services Pty Ltd permission to send out future advertising material
13.2 Neither party shall be liable for any default due to any act of God, war, terrorism, strike, lockout, industrial action, fire, flood, drought, storm or other event beyond the reasonable control of either party.
13.3 AP Plumbing Services Pty Ltd shall not be held liable for damages caused by pre-existing plumbing defects; It is the client’s responsibility to address pre-existing problems and exercise due care to prevent potential loss or damage to Ap Plumping Services Pty Ltd arising out of pre-existing defects; and notify AP Plumbing Services Pty Ltd of any pre-existing defects that the the Client has knowledge of or ought to reasonably have knowledge of.
13.4 AP Plumbing Services Pty Ltd does not accept any responsibility for damage to property during works being carrying out.
13.5 The Client acknowledges that works to be carried out by AP Plumbing Services Pty Ltd may require AP Plumbing Services Pty Ltd to Dig or excavate and may affect the current landscaping to the client’s property. The Client agrees that it will not hold AP Plumbing Services Pty Ltd Liable for any loss or damage incurred arising from services provided by AP Plumbing Services Pty Ltd which require excavation, underground work, removal of landscaping .
13.6 AP Plumbing Services Pty Ltd shall not be held liable for any such delays for work not being completed due to weather conditions, shortage of labor hire, machinery or materials outside the direct control of AP Plumbing Services Pty Ltd
13.7 In the event of any breach of this contract by AP Plumbing Services Pty Ltd the remedies of the Client shall be limited to damages and, in so far as is applicable by law, AP Plumbing Services Pty Ltd’s liability shall not exceed the Price.
13.8 AP Plumbing Services Pty Ltd reserves the right to review and make changes to these terms and conditions at any time.
13.9 These terms are governed by the laws of the State of Victoria.
13.10 If Parts or all of any provisions of these terms that are illegal or unenforceable may be severed from these terms and the remaining provisions of these terms continue in force.
14.0 Mail Delivery Advertising Promotions
14.1 Purpose and Scope
- These Terms and Conditions (“Terms”) govern the use and redemption of promotional offers, discounts, or benefits (“Promotions”) advertised and distributed by AP Plumbing Services Pty Ltd via household mail delivery. By engaging with, redeeming, or attempting to redeem any such Promotion, the recipient (“Customer”, “you”, “your”) agrees to be bound by these Terms.
- These Promotions are intended for residential recipients of AP Plumbing’s mail-delivered marketing material within our service areas.
14.2 Eligibility and General Conditions
- Promotions are valid only for residential homeowners or occupants who have received official AP Plumbing advertising material via direct household mail delivery.
- AP Plumbing reserves the right to decline or withdraw any promotional offer at its sole discretion without prior notice.
- Promotions are non-transferable, not redeemable for cash, and cannot be used in conjunction with any other offers, discounts, or promotions.
- Only one (1) promotion may be applied per household, per booking, per service call.
- Promotions are available for first-time customers only, unless otherwise stated in writing by AP Plumbing.
14.3 Property and Work Conditions
- Properties, developments, subdivided plots, or multi-unit dwellings may not be eligible for mail promotions if there is more than one party entering into a contract for the works to be undertaken.
- In cases where multiple parties are involved (e.g., strata, body corporate, or shared ownership situations), eligibility for promotions will be subject to an on-site agreement between AP Plumbing and all relevant parties prior to commencement of work.
- AP Plumbing reserves the right to verify property ownership and eligibility before applying any promotional discount.
14.4 Pensioner Discounts and Verification
- To qualify for any pensioner benefits or promotions, the customer must present a valid Australian Government Pensioner Concession Card to the on-site AP Plumbing technician at the time of service.
- Failure to present valid identification at the time of service will result in forfeiture of the pensioner-related promotion or benefit.
14.5 Service and Time Restrictions
- Promotions or benefits received from mail delivery advertisements do not apply to:
- After-hours emergency callouts
- Weekend bookings
- Public holiday services
- Promotions are not valid for use on call-out fees, travel charges, or diagnostic fees.
- Promotions apply only to selected services as advertised by AP Plumbing. AP Plumbing reserves the right to determine which services are eligible under each specific promotional offer.
14.6 Redemption and Application
- To redeem a promotion, the customer must present the original mail-delivered advertisement or clearly quote the promotional reference number at the time of booking or service.
- AP Plumbing technicians are not authorised to alter, exchange, or combine promotions.
- Promotions cannot be applied retrospectively to previously completed or invoiced works.
14.7 Limitation of Liability
- AP Plumbing is not responsible for lost, stolen, or damaged promotional materials.
- AP Plumbing will not be held liable for any misinterpretation or misuse of promotional terms by third-party distributors or unauthorised agents.
- AP Plumbing reserves the right to cancel or amend any promotion due to printing errors, system malfunctions, or other unforeseen circumstances.
14.8 Amendments
- AP Plumbing reserves the right to modify, suspend, or terminate these Terms and any associated promotions at any time without prior notice. Any updated Terms will be made available on our official website or through written notice upon request.
14.9 Governing Law
- These Terms are governed by and construed in accordance with the laws of the State of [Insert State, e.g., New South Wales], Australia. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of that State.
15.0 Finance Disclaimer
